Product Warranty
PROTEL, INC. (PROTEL) warrants that all PROTEL® brand products that it manufactures and sells either directly or through an authorized re-seller and/or distributor shall operate in accordance with Protel’s published specifications when properly installed as stated in the product’s installation manual. The warranty period shall remain in effect as stated in the chart below. At its sole discretion, PROTEL will repair or replace products covered under this warranty. Products repaired or replaced under this warranty policy will be covered for ninety (90) days from the date of the returned shipment to Buyer or the remaining original warranty period, whichever is greater.

Power Supplies & Transformers - Six Months From Date of Shipment
RF Radios - Six Months From Date of Shipment
Batteries - 90 Days From Date of Shipment
Interconnect Cables - Out-of-Box Failure Only
Antenna’s - 90 Days From Date of Shipment
Labels & Faceplates - 90 Days From Date of Shipment
Concrete Forms - Out-of-Box Failure Only
The warranty covers all defects in material and workmanship for the duration of the warranty period. The warranty does not cover: (1) Any product that is not purchased from an authorized Protel re-seller and/or distributor. (2) Any product on which the serial number has been defaced, modified, or removed. (3) Damage, deterioration, or malfunction resulting from: a) Accident, act of nature, abuse, negligence, misuse, unauthorized product repair or modifications, improper installation, use, and/or maintenance. b) Damage occurring during product shipment.
THE LIMITED WARRANTY EXPRESSED HEREIN IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY PROTEL. PROTEL MAKES NO OTHER WARRANTY, EITHER EXPRESSED OR IMPLIED, OF ANY KIND INCLUDING WITHOUT LIMITATION ANY WARRANTY OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR LACK OF INFRINGEMENT.
IT IS UNDERSTOOD AND AGREED PROTEL’S LIABILITY WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, IN NEGLIGENCE OR OTHERWISE SHALL NOT EXCEED THE AMOUNT OF THE PURCHASE PRICE PAID BY THE BUYER. THE CORRECTION OF ANY DEFECTS BY REPAIR OR REPLACEMENT WITHIN THE WARRANTY PERIOD SHALL CONSTITUTE THE SOLE AND EXCLUSIVE REMEDY OF BUYER AND SHALL CONSTITUTE THE FULFILLMENT OF ALL OF THE OBLIGATIONS OF PROTEL WITH RESPECT TO ANY WARRANTY GIVEN HEREIN. UNDER NO CIRCUMSTANCES SHALL PROTEL BE LIABLE TO BUYER OR ANY THIRD PARTY FOR LOSS OF PROFITS, DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL, OR OTHER DAMAGES FROM ANY CAUSE WHATSOEVER. THIS PRODUCT WARRANTY IS EXCLUSIVE OF CERTAIN ELECTROMECHANICAL AND ELECTRONIC COMPONENTS THAT ARE WARRANTED BY THEIR RESPECTIVE MANUFACTURER.
NO ACTION, REGARDLESS OF FORM, ARISING BETWEEN PROTEL AND THE BUYER MAY BE BROUGHT BY BUYER MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION HAS ACCRUED OR BEEN DISCOVERED, WHICHEVER IS LATER. PROTEL’S MAXIMUM LIABILITY SHALL NOT EXCEED AND BUYER’S REMEDY IS LIMITED TO EITHER (i) REPAIR OR REPLACEMENT OF THE DEFECTIVE PART OR GOODS, OR AT PROTEL’S OPTION (ii) RETURN OF THE GOODS AND A REFUND OF THE PURCHASE PRICE, AND SUCH REMEDY SHALL BE BUYER’S ENTIRE AND EXCLUSIVE REMEDY.
